Mineral reservations in gold-belt deeds

If a deed anywhere in the chain of title reserved the minerals, or the right to mine, to a prior owner, the title examiner will report it, and it has to be either resolved or accounted for before closing. A buyer who wants clean title to the whole tract will treat an outstanding reservation as a defect.

Georgia law gives surface owners a way to clear an abandoned one. Under O.C.G.A. § 44-5-168, if the holder of the mineral rights has neither worked nor attempted to work them and has paid no taxes on them for seven years, the surface owner can bring an action to claim them, and a judgment for the owner declares the mineral rights lost and vests title in the surface owner. That takes a court filing, so it adds time, but it is a known path.

If you know of old pits, shafts, or prospect trenches on the land, tell us where they are. We buy land with old workings on it. Knowing their location up front keeps them from becoming a surprise during the inspection period.

Cabins, nightly rentals, and student rentals

Lumpkin County will not issue a business and short-term rental license until the property has an approved land use permit from Planning and Development. Licenses renew by December 31 each year. The county raised its hotel-motel tax from 5 to 8 percent for stays on or after August 1, 2023. Platforms such as Airbnb and VRBO remit the tax for bookings made through them, but an owner who rents directly owes it to the county by the 20th of each month.

When you sell, three things matter: whether the land use permit and license are current, whether any direct-booking tax is unpaid, and whether guests are booked past the closing date. The county's page does not say a license moves to a new owner, so we confirm that with Planning before we count on rental income.

Inside Dahlonega, the city runs its own water and sewer. It requires an advance deposit whenever someone other than the owner occupies the property, so a tenant-occupied house will have a deposit on file with the city, refunded after the final bill.

The Lumpkin County Probate Court handles estates and guardianships. The Board of Assessors sets fair market value, and parcel records are on the county's qPublic search. The closing itself is handled by a licensed Georgia attorney.

Lumpkin County Environmental Health keeps septic records by address, and you can request one by email, though it can take up to 48 hours. When you ask us for an offer, the details that move price and timing here are: any mineral reservation in the deeds, the status of a rental permit and lodging tax, the septic record, and, for inherited land, whether an estate has been opened in Lumpkin County Probate Court.

Frequently asked questions

An old deed reserved the mineral rights on my land. Can I still sell?

Yes. We can buy with the reservation in place. If the rights have gone unworked and untaxed for seven years, Georgia law lets the surface owner ask a court to declare them lost, which can be done before or after the sale.

There is an old mine pit on the property. Is that a problem for you?

No. Tell us where it is and roughly how big. We buy land with old workings and plan around them.

My cabin is rented by the night. What do you need to see?

Your land use permit, your county short-term rental license, whether you book through platforms or directly, and the calendar of future bookings.

Do you buy student rentals in Dahlonega?

Yes, with or without tenants in place. Send the leases and the move-out dates.

How do I find out what septic system the house has?

Lumpkin County Environmental Health keeps septic records by property address and takes requests by email. If no record exists, that is common on older houses and we can still buy.
