Private roads and the deed language Dawson requires
Where subdivision roads or stormwater systems have not been accepted by the county, Dawson County's code requires the seller to put a specific statement in the deed and the sales contract. The buyer acknowledges that the roads, common driveways, and stormwater systems are private, that the county does not maintain them, and agrees to hold the county harmless for their upkeep. Maintenance falls to the road owner or to a property owners association that has taken it on, and that designation is also recorded.
This changes a sale in practical ways. A financed buyer's lender may want to see who maintains the road, and a gravel road on a slope that washes out every spring is part of the price. Send us any recorded road maintenance agreement or association documents you have. If there are none, we still buy, and the closing attorney adds the required statement.
Short-term rentals after the September 2025 changes
Dawson County requires a permit for any home rented for 2 to 29 days, and the permit is renewed every 12 months. The application asks for proof of the applicant's ownership, so a buyer applies in their own name. Since September 18, 2025, a new permit is available only on a parcel of at least half an acre, only one site-built house per parcel can be rented, and campers, RVs, tiny houses, and other non-dwelling structures cannot be rented at all. An existing permit on a property that no longer meets those standards can continue as a legal nonconforming use only while the permit stays active.
If your rental is on a septic system, the permit file includes an Environmental Health document showing how many bedrooms the system is approved for and proof the tank was inspected and pumped within the past three years. That paperwork is useful in a sale too, because it answers the septic question before a buyer asks it.
Lanier frontage in Dawson
The parts of Dawson County on Lake Lanier fall under the Army Corps of Engineers' shoreline rules. Under federal regulation, a shoreline use permit for a dock is non-transferable and becomes void when the permitted facility is sold, and the new owner has 14 days to apply for a permit of their own. Have the permit number and the current permit holder's name ready when you request an offer on lake property.

Dawsonville is the county seat, and the county offices are in the courthouse on Justice Way. The Clerk of Superior and Juvenile Courts keeps Dawson's real estate records, including deeds and liens, which are also searchable in the statewide index. The Dawson County Probate Court handles the probate and administration of estates. The Tax Assessor handles homestead and senior exemptions in person, along with conservation use applications. Inside Dawsonville, the city operates its own wastewater system. A Georgia attorney conducts the closing, as state law requires.
For an offer, the facts that move price and timing in Dawson are: whether the road is public or private, whether a short-term rental permit is active and whether the lot is under half an acre, the septic approval and pumping record, any dock permit, and for an inherited house, whether the estate has been opened in Probate Court.
Frequently asked questions
My house is on a private road. Will that hold up the sale?
No. Dawson County requires a statement in the deed that the road is private and not county maintained. The closing attorney handles that language, and we buy on private and gravel roads.
Does my Dawson County short-term rental permit go to the buyer?
The application requires proof of the applicant's ownership, so a buyer applies in their own name. If your lot is under half an acre and your permit is grandfathered, ask the county before assuming a new owner can keep renting.
Can you buy a rental cabin that never had a permit?
Yes. Tell us how it has been rented and whether lodging taxes were collected.
Do you buy on Lake Lanier in Dawson County?
Yes. The dock permit does not transfer automatically, so send the permit details and we account for the buyer's new application.
Do I need to pump the septic tank before selling?
No. If you have a recent pumping receipt or an Environmental Health approval showing the bedroom count, send it. If not, we buy as-is.
