Rental cabins: what stays with the owner

Fannin County's comprehensive plan counts more than 4,000 second homes and over 1,500 short-term rentals, so many of the houses that change hands here have been rented by the night. The county Lodging Department issues the certificate a rental needs and sets the account up in the name on the warranty deed. It tells new owners not to apply until they have closed and have their deed, and its application warns that each night rented without a valid certificate can be fined as much as $1,000.

Inside Blue Ridge city limits, the city runs its own short-term rental certificate, and new rentals are permitted only in the Central Business District. A house elsewhere in the city that was never certified cannot simply become a rental for the next owner, which narrows who will buy it.

Furnishings are taxed too. The Fannin County Assessors Office notes that a vacation rental's contents appear in the digest as Equipment, listed under the owner's name rather than the parcel number, and that a lake house may carry a separate boat listing. Search the digest under your own name before closing so a personal property bill does not turn up after the sale.

Lake Blue Ridge and the TVA dock permit

Lake Blue Ridge is a Tennessee Valley Authority reservoir on the Toccoa River, so a dock, boathouse, or seawall on it needs TVA approval rather than a Fannin County permit. Section 1304.10 of TVA's federal regulations gives a buyer of the land 60 days from the transfer to tell TVA about the change in ownership. Before reissuing the permit in the buyer's name, TVA checks that the dock is in good repair and still matches the rules it was originally approved under.

So a sagging or unapproved dock becomes the buyer's problem the day the deed records, and buyers discount for it. We look at the structure and whatever permit papers you have, and we price the repair in rather than asking you to make it.

Private roads, wells, and septic

Fannin's 2024 Land Development Ordinance requires subdivision plats to state who maintains any private roads, and its standard plat language says the roads are not county-maintained and that upkeep belongs to the property owners association or the owners. If your cabin is reached by a gravel road with no association, or one whose association has stopped collecting dues, a buyer will want to know who repairs it. Any recorded road agreement is worth pulling before you sell. Disputes over a blocked shared road can go to the Fannin County Probate Court, which hears petitions to remove obstructions from private ways.

The county plan notes that many areas have no county water and rely on wells. Septic records are kept by Fannin County Environmental Health in Blue Ridge, and the county's rental application warns that a second dwelling on the same parcel may need an additional environmental health permit. A buyer will compare the bedroom count you advertise with what the septic permit allows.

Records, courts, and closing in Fannin County

Blue Ridge is the county seat. Deeds, plats, security deeds, and liens go to the real estate division of the Fannin County Clerk of Superior Court. Wills and estate administration go through the Fannin County Probate Court. The Tax Assessors Office sets values, and the Tax Commissioner bills real estate and business personal property, normally due by December 20. A Georgia-licensed closing attorney prorates the year's bill between you and us and handles the deed, and for an owner who lives in another state, signing can happen by mail with a local notary.

For a cabin offer we need the address, whether it rents and on which platforms, and anything you know about the road, the well, and the septic tank. The things that move the price or the date here are road access, a dock that needs TVA attention, unpaid personal property or lodging tax, future bookings on the calendar, and, for an inherited cabin, whether an estate has been opened.

Frequently asked questions

Does my Fannin County rental certificate transfer to the buyer?

Not automatically. The county ties the certificate to the name on the warranty deed and asks new owners to apply after closing. That step is on our side, not yours.

Can you buy a lake house with a TVA-permitted dock?

Yes. Filing the ownership change with TVA after closing is our job. Send whatever permit paperwork you have, even if it is old.

My cabin is on a private road with no association. Is that a problem?

Not for us. Tell us how the road is kept up now and whether anything is recorded. It affects value, not whether we buy.

Will you buy a cabin with guest bookings still on the calendar?

Yes. Give us the dates and platforms, and we will set the closing around the last stay or agree on how later bookings are handled.

Do you buy in McCaysville and Morganton too?

Yes, along with Mineral Bluff, Epworth, and the rest of the county.
