Family land, split lots, and septic minimums

Jackson County's Board of Health sets its own minimum lot sizes for septic systems: 0.6 acres when the lot has public water and 1.5 acres when it relies on a private well, with minimum widths of 100 and 150 feet. Those figures assume a typical three- or four-bedroom house, and the board can require more for steep slopes, slow-draining soil, or a larger house. Road right-of-way, power line and pipeline easements, floodplain, and land within 50 feet of a stream or pond do not count toward the total.

That matters when a family wants to sell the house and keep the pasture, or sell a small piece with a well on it. A split that leaves the house on too little usable soil can fail, so the survey and the septic question need answering before anything is signed. For repairs, the health department asks for the home's monthly water usage from the water provider, which is worth having on hand if the system has given trouble.

Manufactured homes and what counts as real estate

A manufactured home in Georgia becomes part of the land only when a Certificate of Permanent Location is recorded with the Clerk of Superior Court and the title is surrendered. Until that happens, the home has its own title, and the Jackson County Tax Commissioner bills it separately; the office lists mobile home and timber taxes alongside property taxes. If an older home was never converted, its title has to be found and signed over at closing.

Two other things come up on rural Jackson parcels. The county's comprehensive plan says Jackson does not want to provide future opportunities for manufactured housing that would undercut its stated values, so anyone planning to replace an old unit should check zoning first. And county code enforcement lists illegal RV or camper occupancy and unsafe or dilapidated structures among the problems it investigates in unincorporated areas, which is often what a relative living in a camper behind the house runs into.

Rivers, buffers, and the I-85 side

The North Oconee, Middle Oconee, and Mulberry rivers are protected corridors in Jackson County, with a 100-foot buffer and a county policy that no building should be placed within 75 feet of the riverbank. A riverfront tract can still be sold; it just has less buildable ground than the acreage suggests.

On the other side of the county, along I-85 at Commerce, are two large battery manufacturing plants. If your property adjoins land shown as industrial on the county's future land use map, tell us, because it changes who wants to buy it and for what.

Records, courts, and closing in Jackson County

Jefferson is the county seat, and both the Clerk of Courts and the Probate Court sit in the courthouse on Jackson Parkway. The Clerk records deeds, security deeds, liens, and plats, with digital images on its public terminals back to 1988. The Probate Court handles wills and estate administration, and its listed jurisdiction includes year's support petitions, which can award property to a surviving spouse or minor children and therefore change who must sign a deed.

A licensed Georgia attorney closes the sale. On a Jackson parcel, the attorney will want the manufactured home title or its permanent location certificate, any recorded survey, and a payoff for property, mobile home, or timber taxes owed.

Frequently asked questions

There is a mobile home on my land as well as a house. Will you buy both?

Yes. Tell us whether the mobile home still has a title or was converted to real property, because that decides how it transfers at closing.

Can I sell the house with a few acres and keep the rest?

Often, but the new lot has to meet the county's septic lot-size rules and zoning. We start with a survey sketch before we write the contract.

A relative lives in a camper behind the house. Is that a problem?

Not for us. County code enforcement does treat camper occupancy as a violation in unincorporated areas, so tell us if there is a notice.

My mother's estate has a year's support petition pending. Can we still sell?

Yes, once the Probate Court rules. A year's support order can change who owns the house, so the closing follows the order.

Do you buy near Commerce and the I-85 corridor?

Yes, along with Jefferson, Hoschton, Arcade, Nicholson, Pendergrass, Talmo, and the rural county.
