Russell Lake frontage is not dock frontage

Richard B. Russell Lake runs along Elbert County's eastern side on the Savannah River. It was built after the Corps of Engineers' December 1974 cutoff, and the Savannah District's shoreline briefing states plainly that private exclusive use is not permitted there. That means no privately owned docks, launch ramps, vista clearings, mowing, gardens, or outbuildings on the public land between a lot and the water.

An adjoining owner keeps the same right to walk the shoreline as anyone else, plus a private access point from the lot onto the public land. That has value, but it is not the dock-and-boathouse lake lot a buyer may picture. Sales that blur the difference tend to fail at appraisal or when the buyer calls the Corps. We price a house near Russell Lake on what the shoreline rules actually allow.

Mobile homes, septic, and wells outside Elberton

The county's 2022 comprehensive plan describes Elbert as very rural outside Elberton, with scattered single-family houses and mobile homes, and it relies on Elberton Utilities for water and sewer in only limited parts of the unincorporated county. Away from those lines, a house is usually on a septic tank and often on a private well.

That matters most when a homesite is being split off family land. The Elbert County Board of Health requires 51,000 square feet for a lot on a private well, with at least 25,500 square feet of usable soil, and land within 50 feet of a lake, stream, or wetland, floodplain, and slopes over 25 percent do not count toward it. A small lot carved out years ago may not have room for a replacement system.

Paperwork is the other common snag. The county's mobile home permit asks that the home's owner match the property owner exactly and that a used home show taxes paid in the county it came from. When a parent owns the land and a son or daughter owns the home, or a title was never signed over, the closing attorney has to line those documents up first. We work through that with you rather than walking away from it.

Records, courts, and closing in Elbert County

Elberton is the county seat. Deeds, liens, and plats are filed with the Elbert County Clerk of Superior Court, which also collects the transfer tax, and the courthouse holds real estate records back to 1790, which helps when a rural chain of title runs through several generations. Wills and estate administration go through the Elbert County Probate Court. The Board of Assessors sets the value on each parcel, and the Tax Commissioner sends the bill.

A licensed Georgia attorney handles the closing. Heirs' property is common on older Elbert tracts, and the attorney will want an estate opened or the heirs legally determined before title insurance can issue. Granite is a common building material across the county, so older houses here can stand on granite piers or behind granite walls, and repairs to those take a mason rather than a handyman.

When you ask for an offer, tell us three things: whether the house is on a well, whether you hold the mobile home title, and whether anyone on the deed has died. Those answers move the closing date more than the condition of the house does, and none of them has to be solved before we make an offer.

Frequently asked questions

Can I put a dock in front of my lot on Russell Lake?

No. Russell is a post-1974 Corps lake, and the Corps does not permit private docks or other private shoreline use there. You keep pedestrian access to the public shoreline.

My mobile home is in my name but the land is in my mother's. Can you buy both?

Yes, as long as both owners sign. The closing attorney will tie the home and the land together so the sale transfers both.

Do you buy houses in Bowman and Dewy Rose?

Yes. We buy in both towns and across rural Elbert County, including homes on large tracts.

The septic system has never been inspected. Will that stop the sale?

No. An unknown or failing system is priced into the offer rather than made a condition of it.

The county has cited my vacant house as dilapidated. Can I still sell?

Yes. Send us the notice or case number; a recorded code lien comes out of your proceeds when we close.
