North Fulton — Sandy Springs, Roswell, Alpharetta, Johns Creek, Milton — is mostly suburban housing from the 1980s onward, with HOAs, basements, and strong school districts. Intown Atlanta is far older: 1900s to 1940s bungalows and craftsman houses in the West End, Westview, Adair Park, Grant Park, and Kirkwood-adjacent neighborhoods, many with original systems. South Fulton — East Point, College Park, Union City, Fairburn — is largely post-war ranch and split-level housing with a high share of rentals.
Those are three different transactions. A Milton house comes to us for hail or a failed inspection. An intown bungalow comes because the family has owned it for sixty years and nobody probated an estate. A south Fulton rental comes because the landlord is done.
Heirs' property is the defining title issue
Fulton County has a great deal of heirs' property, concentrated in historically Black neighborhoods in southwest Atlanta and south Fulton, where houses passed down through generations without any estate being administered. Record title still sits in the name of someone who died decades ago while descendants paid the taxes and maintained the house.
No closing attorney can insure a sale until that chain is cleared — through probate, an order of no administration necessary, or a proceeding to determine heirs. Georgia's heirs-property partition statute gives co-owners a buyout right where one heir pushes for a sale. This is almost always the longest step in a Fulton sale, and it is worth starting before you look for a buyer.
Atlanta code enforcement and rising assessments
The City of Atlanta enforces nuisance, overgrown-lot, and unsafe-structure rules and can pursue demolition with the cost assessed against the property. Charges accumulate quietly on a vacant house while notices go to a stale address, which is a common experience for absentee and heir owners.
Assessments are the other pressure. Georgia values property at fair market value and assesses at 40 percent of it, and as intown values rose sharply, so did bills for owners without a homestead exemption — which includes every estate and every rental. For long-time owners on fixed incomes, the tax bill is frequently what prompts a sale.

Records, courts, and closing in Fulton County
Atlanta is the county seat. Deeds, security deeds, liens, and cancellations are recorded with the Fulton County Clerk of Superior Court and are searchable through the statewide index. Estates run through the Fulton County Probate Court, and if a case is open, the case number tells us most of what we need about timing.
Georgia requires a licensed Georgia attorney to conduct the closing. Seller costs are typically the $1-per-$1,000 transfer tax, attorney and title charges, prorated taxes, and any payoffs or liens.
