Private land in a mostly federal county

Great Smoky Mountains National Park, the Nantahala National Forest, and the Qualla Boundary together take up most of Swain County. The Qualla Boundary is held in trust by the United States for the Eastern Band of Cherokee Indians, and that land is not sold on the open market. What remains for private ownership sits mostly around Bryson City and along the river valleys and lake roads.

That private land tends to come with mountain problems: steep driveways, shared or unrecorded road access, older septic systems, and houses built in stages over decades. We buy with those questions open.

Fontana Lake and TVA permits

Fontana is a TVA reservoir, and docks and shoreline work on it need a TVA Section 26a permit. Those permits do not transfer automatically when a property sells. The new owner has to apply, and only a dock built as the previous permit approved qualifies for an easy transfer. Not every waterfront lot has the land rights to support a dock at all.

If your property has a dock or shoreline work, tell us what you know about its permit. If you don't know, that's fine, but it is better identified now than during a buyer's due diligence.

Values from 2021, and what comes in 2028

Swain County's current values date from its 2021 reappraisal, and the next revaluation is scheduled for 2028. Bills have been stable in the meantime, but a reappraisal after a long gap usually arrives as one large step.

For heirs and out-of-state owners deciding whether to hold a cabin or sell it, that is worth knowing. Delinquent taxes do not have to be cleared first. They come out of the closing proceeds.

  • Manufactured homes on owned land
  • Second homes owned by out-of-state heirs
  • Vacant land with a road or access question

Records, courts, and closing in Swain County

Bryson City is the county seat. Deeds are recorded with the Swain County Register of Deeds, foreclosure hearings and estate files go through the clerk of superior court in Bryson City, and the county tax office sets values. Trust land records are kept separately by the federal and tribal authorities, not by the county.

A licensed North Carolina attorney handles the closing and confirms the property is privately owned fee land before anything records.

Frequently asked questions

Do you buy land on the Qualla Boundary?

No. Trust land is not bought or sold on the open market. We buy privately owned property in the rest of the county.

My Fontana Lake property has an old dock. Does that matter?

TVA permits do not transfer automatically, so we look at the dock's permit status. We buy either way.

My cabin's road isn't on the deed. Can you buy it?

Yes. Access problems are common here, and the closing attorney works through them.

When is Swain County's next revaluation?

It is scheduled for 2028. The current values date from 2021.

Do you buy in Whittier and Almond?

Yes, along with Bryson City and the rest of the privately owned land in the county.
